Overtime Rights & Protections

Are you eligible for overtime compensation?

Many APA members in levels 08–11 are finding themselves directed to flex their schedules rather than receiving the overtime pay they are entitled to. Do not let confusion weaken your rights; your collective bargaining agreement is clear:

ARTICLE 18 – SPECIAL PROVISIONS: Overtime

“Bargaining Unit Employees in grade levels APA 08, 09, 10, and 11 will receive overtime payment at the rate of time and one-half for scheduled hours worked in excess of 40 in a work week. Compensatory time at the same rate may be used where mutually agreed to by the Employee and the Unit Administrator.”

What does this mean for YOU

  • If you are APA 08–11 and required to work outside your regular hours, you are entitled to time-and-a-half pay for those extra hours.
  • You—not management—decide whether you take overtime pay or compensatory time.
  • A supervisor cannot unilaterally change your schedule just to avoid paying you overtime.

If you want to keep your contractual overtime benefits, it is best to let your supervisor know in writing before working any extra hours.

Important distinction: APA 12 and above

Employees at grade level APA 12+ are not eligible for overtime pay. However, if unusual staffing or workload issues arise, a unit administrator may approve compensatory time off equal to the extra hours worked.
